Thoughts Psychological and persuasive analyses of cases, arguments, witnesses, clients and testimony. Compelling facts and arguments are identified. Persuasive problems are noted along with strategies for overcoming them. Credible and convincing themes are identified. Case consultation assesses cases for their persuasive potential and pitfalls, and helps make them persuasive to relevant decision-makers.

Presenter Presentation assistance is provided to attorneys, clients and witnesses to communicate persuasively at hearings, mediations, arbitrations and trials. Knowledge of effective communication strategies is used to assist witnesses to develop skills in conveying case themes, holding up under tough cross-examination, and maintaining good demeanor. Knowledge of the strategy, structure, language, form and content of openings, closings, arguments and motions is used to assist attorneys and clients in maximizing their effectiveness. Preparation of presentations and clients for mediations, hearings, and arbitrations aids in settlement.

MeetingFocus group research is exploratory, occurs in the early to middle stages of litigation, and uncovers attitudes about the parties and issues in the case [READ MORE].  Mock trial research is evaluative, occurs in middle to later stages of litigation, and tests and refines trial strategies and themes in the context of jury deliberations. Attitude surveys occur in any stage of the litigation process, they gather information about venire members’ attitudes toward focused case issues, and they yield the most valid and reliable information for juror profiling. Venue studies occur in any stage of the litigation process, they gather information about venire members’ knowledge and biases about a case, and they guide decisions about if and how to try a case. All research is conducted in the trial venue using respondents matched to known characteristics of the jury pool.

JuryJury selection services include both pre-trial and in-court assistance. Pre-trial, juror profiles are developed for the trial venue and case, juror questionnaires are written, and voir dire questions are recommended. In-court, completed juror questionnaires are scored, voir dire answers are evaluated, and recommendations are made for peremptory strikes. Persuasive strategies for obtaining cause challenges are provided.

WitnessIn-court assistance is provided during trial through trial monitoring, either solely as a consultant or as an overseer of shadow jurors. Jurors’ reactions to witnesses and attorney presentations are monitored, and feedback provided to attorneys to help adapt arguments and themes to ongoing trial events and issues. Attorneys often ask for assessments of the impact of opening statements or the examination of particular witnesses. Post-trial interviews are conducted as soon as possible after trial to capture the reasons for jurors’ decisions, identify misconduct (if that is a concern), and obtain impressions of witnesses, attorneys and arguments.
